EB-1B Outstanding Professors/Researchers
Brief Introduction

EB-1B is an employment-based immigration petition for permanent residency for Outstanding Professors and Researchers. Aliens who are internationally recognized in scientific or scholarly fields for their research or other academic achievements can apply for immigration under this category.
 Aliens qualifying in the EB-1B category are granted a waiver of the Labor Certification requirement, but must have an offer of employment. Permanent job offer includes, but is not limited to, tenure or tenure track positions.

Things to Know

1. Recognition internationally as outstanding in a specific academic field,
2. At least 3-year of teaching or research in the field (research or teaching experience gained while working on an advanced degree can count toward the three-year requirement but only if the research is recognized as outstanding, or if the alien had full responsibility for the course taught), and
3. The offer of a tenured or tenure-track teaching position or the offer if a comparable research position, or
4. The offer of a research position having no fixed term and in which the employee will ordinarily have an expectation of permanent employment, or
5. The offer of a comparable research position with a private employer if the employer has at least 3 full-time researchers and documented accomplishments in the research field.
