NVC-Consulate Process (Employment-Based)
Brief Introduction

Consular Processing is the process by which a beneficiary of immigration petition (either family based or employment based) who is outside the U.S. applies for an immigrant visa at a U.S. consulate overseas. This process will commence only when the underlying immigration petition is approved and visa numbers for the prospective immigrant's country are available.
If the beneficiary is not in the U.S., he/she may choose to immigrate via consular processing abroad. USCIS will transfer the case to NVC, and NVC will hold your case until it becomes current. When an immigrant visa number becomes available, the primary advantage of Consular Processing is speed. The time frame for Consular Processing is between 6 to 12 months, on average. Once the Consular Processing application is approved, the alien is able to gain permanent resident status in the United States.

Things to Know

1. The U.S. based company who is capable of providing full-time, permanent employment;
2. The US Company must be able to pay the beneficiary’s salary;
3. The US Company must intend for the alien to undertake the position.


1. Must be “eligible” for immigration with an approved employment-based immigration petition:
1) Employment First Preference (EB-1)
2) Employment Second Preference (EB-2)
3) Employment Third Preference (EB-3)
4) Employment Fourth Preference (EB-4)
2. Beneficiary should maintain the relevant relationship with Petitioner;
3. Beneficiary must be admissible to the United States.

Filing Fee

1. Immigration Visa Application Processing Fee: $405/person
2. The Affidavit of Support (I-864) processing fee: $88.00 (if applicable)
