NVC-Consulate Process (Family-Based)
Brief Introduction

Aliens who live outside the United States and wish to obtain US permanent resident status generally must obtain immigrant visas at the US consulate or embassy in your resident country.
After USCIS transfers the case to NVC, NVC will hold your case until it becomes current. Petitions may remain at NVC for several months or for many years depending on the visa category and country of birth of the visa applicant. When an applicant's case is about to become current (a visa number is likely to be available within the year), the petition is forwarded to the appropriate U.S. embassy or consulate overseas. (If an applicant is adjusting status in the U.S., the case will be forwarded to the appropriate USCIS office upon request by that office.)

Qualification

Petitioner
1. U.S. Citizen/Permanent Resident
2. If applying for a parent/sibling, the U.S. Citizen must be at least 21
3. Have a domicile in the U.S.
4. Have sufficient financial ability to support the intending immigrant spouse

Beneficiary
1. Must be “eligible” for immigration with an approved family-based immigration petition:
Relatives who don’t need to wait for the quotas:
a) Spouses of U.S. Citizens (IR-1/CR-1)
b) Parents of U.S. Citizens (IR-5)
c) Children of U.S. Citizens (IR-2/CR-2)
Relatives who need to wait for the quotas:
a) Unmarried Sons and Daughters of U.S. Citizens (F-1)
b) Spouses and Children of Permanent Residents (F-2A)
c) Unmarried Sons and Daughters (21 years of age or older) of Permanent Residents (F-2B)
d) Married Sons and Daughters of U.S. Citizens (F-3)
e) Brothers and Sisters of Adult U.S. Citizens (F-4)
2. Beneficiary should maintain the relevant relationship with Petitioner
3. Beneficiary must be admissible to the United States

Filing Fee

1. Immigration Visa Application Processing Fee: $230/person
2. The Affidavit of Support (I-864) processing fee: $88
