Upgrade Immigrant Preference Categories
Brief Introduction

The petitioner becoming a U.S. citizen or the beneficiary getting divorced may result in the upgrade of immigration classification:
If you become a U.S. citizen while your relative is waiting for a visa, you can upgrade your relative’s visa classification and advance the processing of that petition by notifying the appropriate agency of your naturalization. When you are a U.S. citizen, your spouse and
any unmarried children under age 21 will have visas immediately available to them; if you are a U.S. citizen and your son or daughter gets divorced after you have filed the immigration petition for him/her, you can upgrade his/her visa classification, too.

Things to Know

1. Petitioner (Lawful permanent resident) becomes a U.S. citizen while his/her relative is waiting for a visa
2. Beneficiary (U.S. citizen’s married son or daughter) gets divorced when he/she is waiting for a visa
