LPR Child Born Abroad
Brief Introduction

A child is admitted into the U.S. without an immigrant visa as a new immigrant in certain, limited situations. This visa exemption arises if:
The child born to an accompanying parent after issuance of an immigrant visa to the parent but prior to the parent's initial admission as an immigrant (XE3, XF3, XR3 or XN3); or
The child, under 2 years of age, born during a temporary absence of a lawful permanent resident mother if the child is accompanying the parent who is reentering the United States as a returning resident for the first time after the birth of the child (NA3).

Things to Know

A child born during the temporary visit abroad of a mother who is a lawful permanent resident alien of the United States, provided that the child’s application for admission to the United States is made within 2 years of birth, the child is accompanied by the parent who is applying for readmission as a permanent resident upon the first return of the parent to the United States after the birth of the child, and the accompanying parent is found to be admissible to the United States, or
A child born subsequent to the issuance of an immigrant visa to his or her accompanying parent who applies for admission during the validity of such a visa.
